Please read these Terms of Service ("Terms") carefully before using the website located at varona.ai (the "Site") operated by Varona Systems, LLC, doing business as Varona AI ("Company," "we," "us," or "our"). 2. Description of Services

Varona AI provides information about its managed and professional services in Artificial Intelligence and Machine Learning (AIOps / MLOps), including but not limited to cloud migration, backup and disaster recovery, scaling, and AI integrations and business automation (collectively, the "Services"). Detailed terms governing specific engagements are set forth in separate service agreements executed between the Company and its clients.

3. SMS Communications

By providing your phone number and opting in to text message communications, you consent to receive SMS messages from Varona AI at the number provided. These messages may include service updates, notifications, and other information related to your engagement with us.

• Message frequency: Varies based on your engagement and preferences.
• Message and data rates may apply, depending on your mobile carrier plan.
• Opt-out: Reply STOP at any time to unsubscribe. You will receive a single confirmation and no further messages.

Varona AI does not share SMS opt-in data or consent with third parties for their marketing purposes.

4. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Varona Systems or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

To the fullest extent permitted by applicable law, Varona Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site shall not exceed one hundred U.S. dollars (USD $100).

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
